These Terms of Service ('Terms', 'Agreement') constitute a legally binding agreement between you ('User', 'you') and DomuHq s.r.o., a limited liability company incorporated under the laws of the Czech Republic, with registered office at Poličanská 1487, 190 16 Prague - Újezd nad Lesy, identification number (IČO): 23641550 ('DomuHq', 'we', 'us', 'our', 'Company'). These Terms govern your access to and use of the DomuHQ platform, including our website, mobile applications, and all related services (collectively, the 'Service' or 'Platform'). BY CREATING AN ACCOUNT OR USING OUR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICE.
1.1 Definitions
For purposes of these Terms, the following definitions apply:
- –"Account" means the user account created to access and use the Service.
- –"Content" means any information, data, text, photographs, videos, messages, listings, or other materials uploaded, posted, or transmitted through the Service.
- –"Community Guidelines" means the acceptable use policies available at domuhq.cz/guidelines.
- –"Consumer" means a natural person who, when entering into a contract with DomuHq, is not acting within the scope of their business activity or independent exercise of their profession, as defined by Act No. 89/2012 Coll., the Civil Code.
- –"Host" means a User who lists property (rooms, apartments, shared housing) on the Platform.
- –"Personal Data" has the meaning set forth in Regulation (EU) 2016/679 (GDPR).
- –"Privacy Policy" means our privacy policy available at domuhq.cz/privacy.
- –"Renter" means a User seeking to rent property through the Platform.
- –"Service Provider" means a verified business offering services (moving, cleaning, repairs) through the Platform.
- –"Squad" means a group of Users collaboratively searching for housing.
- –"Subscription" means a paid membership plan providing access to premium features.
- –"User Content" means Content submitted, posted, or transmitted by Users.
- –"Verification" means the identity and document verification process conducted through third-party providers.
1.2 Interpretation
- –Headings are for reference only and do not affect interpretation.
- –References to "include" or "including" are not limiting.
- –References to Czech legislation include amendments and replacements.
- –The singular includes the plural and vice versa.

These Terms govern access to and use of DomuHq’s website, mobile apps, and related services (the “Service” / “Platform”).
BY CREATING AN ACCOUNT OR USING OUR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY.
2.1 Binding Agreement
By accessing or using the Service, you:
- –Represent that you have read and understood these Terms;
- –Agree to be legally bound by these Terms;
- –Agree to comply with all applicable Czech and European Union laws;
- –Accept our Privacy Policy and Community Guidelines as incorporated herein by reference.
2.2 Amendments
We reserve the right to amend these Terms at any time. Material changes will be communicated via:
- –Email to your registered email address;
- –Prominent notice on the Platform;
- –In-app notification.
Amendments take effect fourteen (14) days after notification (unless otherwise required by law). Continued use after the effective date constitutes acceptance.
2.3 Additional Terms
Certain features or services may be subject to additional terms and conditions presented at time of use and incorporated by reference.
ACCEPTANCE OF TERMS (SUMMARY BOX)
By creating an account, accessing, or using DomuHq, you acknowledge: 1) You have read and understood these Terms; 2) You agree to be legally bound by these Terms and incorporated policies; 3) You consent to Personal Data processing per the Privacy Policy; 4) You are at least 16 and have legal capacity to contract; 5) If under 18, you have parental/guardian consent; 6) You will comply with laws and these Terms; 7) DomuHq is an intermediary and not party to User agreements; 8) You accept limitations of liability, disclaimers, and dispute resolution provisions. If you do not agree, you must cease using the Service and may not create an Account.

3.1 Platform Purpose
DomuHq operates a digital platform providing:
- –Roommate matching services based on personality assessment and compatibility algorithms;
- –Property rental listings connecting Renters with Hosts;
- –Squad functionality for group housing searches;
- –Service marketplace connecting Users with verified Service Providers;
- –Communication and transaction facilitation tools.
3.2 Service Scope
The Service includes:
- –User profile creation and management;
- –Psychometric assessments (validated models, compatibility scoring);
- –Property and room listings with search and filtering tools;
- –Identity verification services (provided by Didit);
- –Secure messaging and communication features, including optional automatic message translation between Czech and English (powered by DeepL; message content is sent to DeepL for translation when enabled by the user);
- –Google Calendar integration for scheduling property viewings (requires separate authorization; only event date, time, and title are accessed);
- –Czech address autocomplete for property listings (powered by Mapy.cz);
- –Payment processing via Stripe (web) and Apple StoreKit (iOS);
- –Mobile apps (iOS; Android coming soon) and web platform;
- –Electronic document signing for rental agreements and contracts (planned feature; provider to be disclosed when launched);
- –Customer support services.
3.3 Geographic Scope
The Service primarily operates in the Czech Republic (initial focus on Prague) with planned expansion.
Use of the Service outside the Czech Republic is at your own risk and subject to local laws.
3.4 Platform Role
DomuHq acts as an intermediary platform only.
DomuHq facilitates tools for matching/communication/transactions but does not enter into rental or service contracts for Users.
- –DomuHq is NOT party to agreements between Users.
- –DomuHq does NOT guarantee quality, safety, legality, or accuracy of User Content or interactions.
3.5 AI-Powered Features and Automated Decision-Making
DomuHq uses AI/automated systems for: matching/compatibility, content moderation, fraud detection, listing optimization, and DomuBot support.
- –AI matching is probabilistic and does not guarantee successful roommate relationships.
- –AI moderation may produce false positives/false negatives; appeals are available.
- –Fraud detection may trigger restrictions pending human review.
- –DomuBot is AI; responses may contain errors; complex issues escalate to humans.
- –You may request human review and explanation of certain AI decisions (GDPR Article 22 / EU AI Act references).
Human oversight applies to high-impact decisions (e.g., suspensions/bans, moderation appeals, verification rejections, fraud investigations).
3.6 Digital Services Act (DSA) Compliance
DomuHQ operates as an intermediary hosting service provider within the meaning of the Digital Services Act (Regulation (EU) 2022/2065).
- –We provide mechanisms for reporting illegal content (in-app report feature and support@domuhq.cz).
- –We act expeditiously to remove or disable access to illegal content upon obtaining knowledge.
- –We publish transparency information regarding content moderation decisions.
- –Users may appeal content moderation decisions by contacting support@domuhq.cz within 14 days.
As a micro/small enterprise, certain DSA obligations (e.g., annual transparency reports) are proportionally applied.
4.1 Age Requirement
- –Minimum age: 16 to create an Account and use the Service.
- –Users under 18 must obtain parental/legal guardian consent.
- –DomuHq may request proof of age/consent.
4.2 Legal Capacity
- –You have legal capacity to contract under Czech law.
- –You are not prohibited from using the Service.
- –Your use does not violate other agreements you are party to.
4.3 Account Registration
To create an Account, you must provide:
- –Full legal name;
- –Valid email address;
- –Mobile phone number;
- –Date of birth;
- –Password meeting security requirements;
- –Acceptance of Terms and Privacy Policy.
- –Alternatively, you may register using a supported third-party authentication provider (Google, Facebook, or Apple Sign-In). By doing so, you authorize DomuHQ to access the basic profile information provided by that provider (name, email address, profile photo) as described in our Privacy Policy. You remain responsible for the accuracy of all Account information regardless of registration method.
Providing false information is a material breach and may result in immediate termination.
4.4 Account Security
- –Keep credentials confidential and notify DomuHq of unauthorized access.
- –DomuHq implements security measures but cannot guarantee absolute security.
4.5 One Account Per User
Each User may maintain only one (1) Account.
Exception: Professional Hosts may maintain separate professional Host Accounts with prior written approval.
4.6 Account Transfer
Accounts are personal and non-transferable without prior written consent.
5.1 Subscription Tiers
DomuHq offers the following subscription tiers:

- –Restrictions: cannot initiate connection requests; cannot send first messages; cannot apply to rental properties; cannot join/create Squads; cannot host/list properties

- –Price: 299 Kč/month (including VAT)
- –All DomuBasic features, plus:
- –Identity Verification badge
- –Unlimited messaging (initiate and respond)
- –Send connection requests to verified Users
- –Apply to rental properties
- –Join and create Squads
- –Spare room hosting (1 room maximum)
- –AI photo ranking & profile optimization
- –Weekly compatibility digest (Top 5 matches)

- Professional Host Tiers
- –DomuPro Host (999 Kč/month): 1–3 listings; AI listing optimization; basic analytics & tenant screening; IČO/DIČ verification; contract templates; multi-language support (CZ/EN)
- –DomuPremium Host (1,999 Kč/month): 5–10 listings; advanced analytics & market intelligence; team collaboration; bulk management; enhanced priority support
- –DomuEnterprise Host (2,999 Kč/month): unlimited listings; enterprise analytics & custom reports; advanced team management; white-label options; dedicated account manager; custom API integrations
- –Note: Upgrading to Professional Host tiers temporarily suspends personal Roommate/Renter features; 90-day grace period to reactivate by downgrading to DomuPlus.
5.2 Payment Terms
- –Prices are in Kč and include VAT (currently 21% for electronic services).
- –Prices may change with 30 days’ notice; changes don’t affect current billing period.
- –Payment methods include cards (Visa/Mastercard), bank transfer (annual), and others available on the Platform.
- –By subscribing, you authorize recurring charges and confirm you can use the payment method.
Payment processing is handled by Stripe (web) and Apple StoreKit (iOS in-app purchases). DomuHq does not store full card details. See our Privacy Policy for details on payment data processing.
5.3 Billing and Automatic Renewal
- –Monthly: billed same day each month as initial subscription date.
- –Quarterly (DomuPro): billed every 3 months.
- –Annual: billed every 12 months.
- –Subscriptions renew automatically unless cancelled; renewal notifications sent at least 7 days before renewal.
5.3.3 Failed Payments
- –DomuHq attempts re-processing and notifies you.
- –You have 7 days to update payment info.
- –After 7 days, subscription downgrades to DomuBasic; paid features suspended until payment succeeds.
5.4 Cancellation, Refunds, and Withdrawal Rights
- –Cancel via Account settings or by emailing support@domuhq.cz; cancellation takes effect end of billing period.
- –No partial refunds unless required by law.
- –Consumers have a 14-day cooling-off withdrawal right (Act No. 634/1992 Coll.).
- –Withdrawal requests: email support@domuhq.cz with subject “Withdrawal from Subscription Agreement” and purchase details.
- –After 14 days: fees are generally non-refundable except non-delivery/material breach/legal requirement.
- –Chargebacks without first contacting DomuHq may lead to suspension/restriction/collections.
5.5 Price Changes and Modifications
- –Price increases require at least 30 days’ notice.
- –New pricing applies at next renewal; continued use after notice = acceptance.
- –If you don’t accept, you may cancel before new pricing applies.
5.6 Taxes
You’re responsible for any taxes (other than VAT included) applicable to your use of the Service.
6.1 Ownership of User Content
You retain ownership of Content you submit (User Content), including:
- –Profiles & photos
- –Property listings & images
- –Messages
- –Reviews & ratings
- –Squad communications
6.2 License to DomuHq
By posting User Content, you grant DomuHq a worldwide, non-exclusive, royalty-free, sublicensable license to:
- –Use, reproduce, modify, adapt, publish, translate, and distribute User Content;
- –Display User Content on the Platform and in promotional materials;
- –Create derivative works for Platform operation/improvement;
- –Store User Content on servers and backups.
License continues until deletion/termination, with exceptions for retained messages/reviews per Privacy Policy and legal retention.
6.3 Responsibility for User Content
- –You are solely responsible for all User Content you post or transmit;
- –You ensure it does not violate Terms, laws, or third-party rights;
- –You have obtained all necessary permissions and consents;
- –You are responsible for accuracy and legality.
DomuHq does not pre-screen all content but may review, edit, or remove content.
6.4 Prohibited Content
- –Illegal/harmful content (law violations, fraud/scams, malware, IP infringement, privacy violations).
- –Offensive content (hate speech, harassment, defamation, sexually explicit content, violence/self-harm depictions).
- –False/misleading content (fake info, misrepresentation, fraudulent listings/reviews).
- –Spam/commercial misuse (unsolicited marketing, repetitive messaging, unauthorized advertising).
6.5 Prohibited Activities and Conduct
- –Impersonation, fake/duplicate accounts, identity theft.
- –Harassment, stalking, threats, bullying, discrimination.
- –Circumventing security/verification; bots/scrapers; hacking attempts; reverse engineering; malware.
- –Off-platform transactions to avoid fees/verification or collect payment info directly (except permitted for legitimate service bookings).
- –Manipulating reviews/ratings/compatibility or scraping personal data.
6.6 Reporting Violations
- –Report via in-app feature or email support@domuhq.cz.
- –DomuHq investigates and may warn, remove content, suspend/terminate, report to authorities when required.
Target response: within 48 hours; urgent safety concerns prioritized.
6.7 Consequences of Violations
- –Minor: warning, temporary restrictions, removal requirement.
- –Repeat/serious: suspension (7–30 days) or permanent ban; no refunds for violations.
- –Illegal activity: immediate termination and reporting to authorities.
7.1 Verification Services
Verification is conducted through our identity verification partner, Didit Identity Spain SL, an EU-based provider (AWS Ireland). See our Privacy Policy for data processing details.
- –Basic Identity Verification (included in DomuPlus): ID verification, biometric selfie/liveness, address verification, email/phone verification.
- –Enhanced Verification (optional add-on): background check (where permitted), income verification, credit assessment, rental history.
- –Property Ownership Verification (Hosts): Cadastre confirmation, Power of Attorney/authorization, IČO/DIČ verification for business hosts.
7.2 Verification Requirements
- –Required for: sending messages/requests (DomuPlus+), applying to rentals, joining/creating Squads, hosting/listing, offering services.
- –DomuBasic may optionally verify to increase trust.
7.3 Verification Process
- –Provide accurate documents and clear images; complete biometric verification; consent to third-party processing.
- –Standard verification: 24–48 hours; ownership verification: 2–3 business days; enhanced: 3–5 business days.
- –Approved: badge + access to verified features; Rejected: explanation + opportunity to resubmit.
7.4 Verification Standards and Limitations
- –Verification confirms documents appear authentic and checks were completed.
- –Verification does NOT guarantee trustworthiness, no criminal history (unless enhanced), or quality of housing/services.
Users must conduct their own due diligence and use safety precautions.
7.5 Data Processing for Verification
- –Third-party providers process ID/biometric data under GDPR.
- –DomuHq retains verification status; providers retain documents/biometrics typically 5 years for AML/KYC.
7.6 Verification Badge and Status
- –Badge is visible to other Users.
- –Status valid unless account changes, documents expire, fraud detected, or revoked.
DomuHq may require re-verification to maintain platform integrity.
8.1 Listing Accuracy and Completeness
- –Listings must be accurate, current, and complete (defects, rules, utilities, deposit terms, lease terms, legal issues/renovations).
- –No misrepresentation: unauthorized photos, manipulated images, omitted defects, false amenities, unavailable properties, bait-and-switch.
Violations may result in removal, suspension/termination, liability, and legal action.
8.2 Property Ownership and Authorization
- –Owners: Cadastre confirmation, deed/title documents.
- –Agents/managers: Power of Attorney, management agreement, agency contract.
- –Subletters: landlord consent + primary agreement allowing subletting.
- –Unauthorized listings are a material breach and may be illegal.
8.3 Compliance with Czech Rental Laws
- –Comply with Czech Civil Code and applicable rental/consumer laws and safety standards.
- –Deposits limited to max 3 months’ rent; return typically within 30 days minus legitimate deductions.
- –Provide written agreements; respect notice periods and tenant rights.
8.4 Discrimination Prohibited
- –No refusal or different terms based on protected characteristics (Anti-Discrimination Act / Charter rights).
- –Allowed: legitimate non-discriminatory preferences (non-smokers, no pets for legitimate reasons, lifestyle compatibility).
- –Complaints can be reported to authorities and DomuHq support.
8.5 Listing Approval and Moderation
- –All listings are subject to review; DomuHq may approve/reject/request info/edit with consent/remove violating listings.
- –Standard review: 24–48 hours; ownership verification listings: 2–3 business days.
8.6 Listing Management and Updates
- –Update availability, remove unavailable listings, respond within 24 hours, maintain accurate pricing and calendars, honor commitments.
- –Inactive listings (no activity for 90 days) may be deactivated with notice.
9.1 Squad Formation and Purpose
- –Group housing search collaboration: shared favorites, group messaging, coordinated applications, compatibility tracking.
9.2 Squad Creation and Membership
- –Only verified Users (DomuPlus+) may create/join.
- –Size: 2–10 members.
- –Creator has admin privileges; DomuPro can create custom application questions.
9.3 Governance and Responsibilities
- –Respectful communication, good faith participation, honor commitments, comply with Terms/Guidelines.
- –DomuHq does not mediate internal disputes; members should resolve or dissolve.
9.4 Squad Dissolution
- –Dissolve by creator, unanimous vote, or automatically if membership < 2.
- –Inactive for 90 days → dissolution (7-day notice).
- –Data archived per retention policies.
9.5 DomuHq’s Role
- –Provides tools only; not party to Squad agreements; no guarantee of success/compatibility; may dissolve violating Squads.
10. Service Marketplace
Note: The Service Marketplace is a planned feature and will be available in a future update. The following terms will apply when the feature launches.
10.1 Service Marketplace Overview
- –Connects Users with verified Service Providers (moving, cleaning, repairs, legal/admin help, other housing-related services).
10.2 Service Provider Verification
- –Must be registered Czech business (IČO/DIČ/Živnostenský list), meet compliance, provide insurance (where required), licenses/certs (where required).
10.3 Service Bookings and Agreements
- –Users can browse/request quotes/book and message securely.
- –DomuHq facilitates only; service contracts are between User and Provider.
10.4 Payment for Services
- –Payments may be through Platform or direct between parties (off-platform allowed for services subject to safety guidelines).
- –Marketplace fee may apply (percentage commission disclosed at booking).
10.5 Service Quality and Disputes
- –Users should verify credentials/reviews and inspect work.
- –Disputes should be resolved between User and Provider; DomuHq may assist optionally and may suspend/remove Providers for repeated issues.
DomuHq is not liable for service quality, non-performance, or damages from services.
11.1 Incorporation of Privacy Policy
Your use of the Service is governed by our Privacy Policy (domuhq.cz/privacy), incorporated by reference.
11.2 GDPR Compliance
- –GDPR (EU 2016/679).
- –Czech Act No. 110/2019 Coll. (GDPR implementation).
11.3 Data We Collect
- –Account data (name, email, phone, DOB).
- –Profile data (photos, assessment results, preferences).
- –Verification data (handled by third parties).
- –Property data (listings, photos, pricing).
- –Communications (messages, reviews, ratings).
- –Usage data (activity, device info).
- –Payment data (processed by third parties).
- –Location data (approximate IP/GPS with consent).
11.4 How We Use Your Data
- –Operate and improve platform.
- –Matching, communication, transactions.
- –Verification and fraud prevention.
- –Payments/subscriptions.
- –Support and notifications.
- –Legal compliance and enforcement.
11.5 Data Sharing
- –With other Users as needed for functionality.
- –With service providers (verification, payment, hosting, analytics) under DPAs.
- –With authorities where required by law.
DomuHq does not sell Personal Data to third parties for marketing.
11.6 Your Data Rights
- –Access, rectification, erasure, restriction, portability, objection, withdraw consent.
- –Complain to Czech Office for Personal Data Protection (ÚOOÚ).
- –Requests via privacy@domuhq.cz or domuhq.cz/gdpr; response within 30 days (extendable).
11.7 Data Retention
- –Account: until deletion (or as required).
- –Verification: typically 5 years (AML/KYC).
- –Transactions: 10 years (accounting/tax).
- –Comms: for disputes/compliance.
- –Anonymized analytics: indefinitely.
11.8 Data Security
- –Encryption in transit/at rest, access controls, audits, training.
- –No system is 100% secure; absolute security not guaranteed.
11.9 International Data Transfers
- –All personal data is primarily stored and processed within the EEA (AWS EU-Frankfurt, AWS EU-Ireland). Limited transfers outside the EEA may occur for specific sub-processors (e.g., Stripe, Anthropic) under Standard Contractual Clauses (SCCs) approved by the European Commission.
12.1 DomuHq Property and Ownership
- –Platform UI/design, software/code/algorithms, brand/trademarks, DomuHq-created content, databases are owned by DomuHq or licensors.
- –Protected by Czech/EU/international IP laws (copyright, trademark, database rights, trade secrets).
12.2 Limited License to Users
- –Limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.
- –Restrictions: no copying/distributing/modifying, reverse engineering, removing notices, using brand without permission, scraping, competing commercially.
12.3 User Content License (For Clarity)
As stated in Section 6.2, by posting User Content, you grant DomuHq a license to use it for Platform operation and promotion.
You retain ownership of your User Content.
12.4 Trademarks
DomuHQ marks are trademarks/registered trademarks of DomuHq s.r.o. Use requires permission except incidental linking/discussion in good faith.
12.5 Copyright Infringement Claims (DMCA-Style Notice)
- –Send notice to legal@domuhq.cz with subject “Copyright Infringement Claim”.
- –Include work identification, location, contact info, good-faith statement, accuracy statement, signature.
- –DomuHq may remove content, notify user, terminate repeat infringers; counter-notice possible.

- –Use at your own risk.
14.1 “As Is” and “As Available”
- –Service provided without warranties to the fullest extent permitted by Czech law.
- –No guarantee of accuracy, availability, results, or absolute security.
14.2 User Interactions and Third-Party Content
- –DomuHq does not guarantee user conduct or truthfulness.
- –Users must verify information, do due diligence, and take safety precautions.
14.3 Property and Service Quality
- –DomuHq does not inspect properties or guarantee habitability/legality.
- –Verification is not endorsement of service providers.
14.4 Compatibility and Technology
- –We do not guarantee compatibility with all devices or error-free operation.
- –Psychometric assessments are for informational purposes only.
14.5 Consumer Rights Protection
Nothing in disclaimers limits statutory Consumer rights under Czech law and GDPR.
15.1 Limitation of Damages
Total liability is limited to the amount you paid to DomuHq in the 12 months before the claim.
For DomuBasic users, maximum liability is 100 Kč.
15.2 Exclusion of Consequential Damages
- –No liability for indirect/incidental/consequential/punitive damages (lost profits, data, goodwill, etc.), except where Czech law requires.
15.3 Specific Exclusions
- –Not liable for User/Host/Renter/Provider conduct.
- –Not liable for third-party services failures/data practices.
- –Not liable for property condition/legality/safety.
- –Not liable for unauthorized access caused by user security failures (unless gross negligence by DomuHq).
- –Not liable for force majeure events.
15.4 Basis of the Bargain
- –These limitations are fundamental elements of the agreement; DomuHq would not provide the Service without them.
- –Pricing reflects this allocation of risk.
15.5 Consumer Rights Protection
- –Limitations don’t apply where law prohibits, including death/personal injury from DomuHq negligence, fraud, and non-excludable rights.
16.1 Your Indemnification Obligation
- –You indemnify DomuHq and related parties for claims arising from your use, violations, content, conduct, interactions, off-platform activity, and IP infringement claims.
16.2 Defense and Settlement
- –DomuHq may assume defense; you must cooperate and not settle without consent.
Indemnification survives termination.
16.3 Limitation for Consumers
- –Consumer indemnification is limited as permitted by Czech consumer law and does not cover DomuHq gross negligence/willful misconduct.
17.1 Governing Law
Czech Republic law governs these Terms and your use of the Service.
17.2 Informal Dispute Resolution
- –Step 1: Contact support@domuhq.cz (allow 14 days).
- –Step 2: Good-faith negotiation (up to 30 days).
- –Step 3: Optional mediation (costs shared equally).
17.3 Jurisdiction and Venue
- –Consumers: claims may be brought in your EU residence courts or Prague; DomuHq can only sue consumers in consumer residence courts.
- –Business users: exclusive jurisdiction Prague courts.
- –Users outside EU: consent to Czech courts.
17.4 ADR for Consumers
- –ČOI consumer ADR scheme (coi.cz).
- –EU ODR platform (ec.europa.eu/consumers/odr).
- –Other bodies may apply (arbitration/payment disputes).
ADR is voluntary and does not remove your right to go to court.
17.5 Class Action Waiver (Business Users)
- –Business users waive class/collective actions where permitted.
- –Does not apply to consumers if prohibited by law.
17.6 Time Limitation for Claims
- –Claims subject to Czech limitation periods (often 3 years contract claims).
- –Consumer defects claims generally 2 years.
18.1 Termination by You
- –Delete account via Settings > Account > Delete Account, or email support@domuhq.cz with “Account Deletion Request”.
- –Requests processed within 7 business days.
No refunds for current billing period except where required by law or stated in refund section.
18.2 Termination by DomuHq
- –DomuHq may suspend/terminate for violations, suspected fraud/illegal activity, harm to others/company, legal requirements, or service discontinuation.
- –You may appeal within 14 days by contacting support@domuhq.cz.
18.3 Effect of Termination
- –Access ends; paid features deactivate; listings removed; squad memberships end; bookings cancelled.
- –Some data retained for legal/tax/compliance; messages shared with others may remain.
Certain provisions survive (User Content license, privacy, IP, disclaimers, liability, indemnification, dispute resolution, general provisions).
18.4 GDPR Right to Erasure
- –Account deletion triggers deletion/anonymization within 30 days unless retention required by law or for legal claims.
- –Requests via account deletion or privacy@domuhq.cz / domuhq.cz/gdpr.
19.1 Entire Agreement
- –These Terms + Privacy Policy + Community Guidelines + Cookie Policy + additional feature terms form the entire agreement.
19.2 Amendments and Updates
- –Material changes communicated via email, platform notice, or in-app notifications.
- –Effective after 14 days (or longer if required for Consumers).
- –Previous versions available upon request (legal@domuhq.cz).
19.3 Severability
If a provision is invalid, it is modified or severed; remaining provisions stay effective.
19.4 No Waiver
Failure to enforce is not a waiver; waivers must be written and signed.
19.5 Assignment
- –Users cannot assign without consent.
- –DomuHq may assign to affiliates/successors/third parties with notice (and consent where required).
19.6 Force Majeure
- –No liability for delays/failures beyond reasonable control (disasters, war, outages, pandemics, cyberattacks).
- –If force majeure > 60 days, either party may terminate.
19.7 Relationship of the Parties
Independent contractors; no employment/agency/partnership/joint venture; no authority to bind the other.
19.8 No Third-Party Beneficiaries
Only you and DomuHq benefit, except indemnified parties under indemnification section.
19.9 Language
- –English and Czech versions exist.
- –Czech version is legally binding for Czech law disputes; English is convenience.
- –If discrepancies, Czech version prevails for Czech law matters.
19.10 Notices
- –To DomuHq: legal@domuhq.cz and postal address DomuHq s.r.o., Poličanská 1487, 190 16 Praha - Újezd nad Lesy, Czech Republic (IČO: 23641550).
- –To you: email, in-app notifications, postal where required.
- –Deemed received: email after 24h; post after 5 business days; in-app when displayed.
19.11 Headings
Headings are for reference and convenience only and do not affect interpretation.
19.12 Interpretation (General)
- –"Include/including" means including without limitation.
- –Singular/plural rules apply; “or” may mean and/or; days are calendar days unless stated.
